Oodles Messaging Policy

This Oodles Messaging Policy applies to all SMS, MMS, chat, and WhatsApp messages sent by Oodles on behalf of our merchant customers. This policy ensures compliance with applicable laws, guidelines, and standards to maintain messaging integrity and respect recipient preferences.

1. Consent / Opt-In Requirements

To protect recipients from unwanted messages, merchants using Oodles must obtain clear, verifiable consent from message recipients before sending any communication:

  • Opt-In Documentation: Consent must be documented, including timestamps or signed forms, indicating that the recipient agreed to receive the specific type of message.
  • Reconfirmation: If the first message is not sent soon after obtaining consent, reconfirm consent with the initial message sent.
  • Purpose-Specific Consent: Consent applies only to the specific campaign or use. Merchants cannot assume blanket consent for unrelated messages or campaigns.

2. Sender Identification

All messages must identify the sender, clearly indicating the brand name or organization that received the opt-in consent. Identification should be maintained in all initial messages and periodically in follow-up communications for clarity.

3. Opt-Out Mechanism

Each message must include an opt-out option, such as: “Reply STOP to unsubscribe.” Customers can opt out anytime, and merchants are required to immediately honor all opt-out requests, ceasing further communications with the recipient.

4. Quiet Hours and Message Frequency

To adhere to Florida Mini-TCPA standards and industry best practices:

  • Quiet Hours: Messages are restricted to 8 am – 8 pm in the recipient’s time zone.
  • Message Frequency: A maximum of three message attempts per recipient is allowed within a 24-hour period, regardless of the originating number.

5. Filtering Evasion

Merchants must not attempt to bypass message filtering or blocking mechanisms, which are in place to prevent unwanted or excessive communications. Activities such as sending repeat messages in quick succession or using random source numbers to avoid detection are strictly prohibited.

6. SHAFT Policy Compliance

Oodles prohibits SMS marketing for content related to Sex, Hate, Alcohol, Firearms, and Tobacco (SHAFT) in accordance with U.S. and Canadian industry standards. Any messages containing such content may lead to immediate account suspension.

  • Alcohol and Age-Restricted Content: Age verification is required for alcohol-related promotions, including clear age prompts and in-message age confirmation (e.g., “Please confirm your birthdate: YYYY-MM-DD”).

7. Enforcement and Penalties

Oodles reserves the right to suspend or terminate accounts found in violation of this policy or applicable laws. Additionally, Oodles may report any violations that harm individuals or breach legal standards to the relevant authorities and cooperate with their investigations.

8. Policy Updates

Oodles may update this Messaging Policy as required. Changes will be communicated via email, our website, or in-app notifications.
